Davenport’s Landscapes

Welcome to Davenport’s Landscapes.

These Terms and Conditions govern the use of our garden design and landscaping services. By engaging our services, you agree to the terms outlined below.

1. Services Offered

Davenport’s Landscapes provides professional garden design, landscaping, and related consultation services tailored to residential and commercial outdoor spaces. Specific services, deliverables, and timelines will be confirmed in writing before the start of any project.

2. Pricing and Payment

  • Minimum Project Fee: Our garden design and landscaping services start from £750. Prices vary depending on project scope, materials, and complexity.

  • Deposit: A non-refundable deposit of £400 is required to secure your booking and initiate design work. This will be deducted from your final invoice.

  • Final Payment: The remaining balance is due within 7 days of the final invoice date, unless otherwise agreed in writing.

  • Late Payments: We reserve the right to charge interest on overdue payments at a rate of 4% above the Bank of England base rate, calculated daily.

3. Cancellations and Refunds

  • Cancellations made within 48 hours of booking may be eligible for a partial refund, at our discretion.

  • Deposits are non-refundable once work has commenced.

  • If you cancel after design work has begun, you will be responsible for the cost of completed work and any non-recoverable expenses incurred.

4. Changes and Delays

  • All requests for changes to the agreed design or project scope must be made in writing.

  • Additional work or changes may incur extra charges and affect the delivery schedule.

  • While we strive to meet agreed timelines, we are not liable for delays caused by unforeseen circumstances beyond our control.

5. Access and Responsibilities

  • Clients must ensure clear and safe access to the property and work areas during agreed working hours.

  • It is the client’s responsibility to inform us of any underground services, restrictions, or hazards before work begins.

  • ​

6. Materials and Planting

  • We source high-quality plants and materials, but natural variations in size, color, and growth are to be expected.

  • We cannot guarantee the survival of plants once they have been planted, unless part of an ongoing maintenance agreement.

  • ​

7. Liability

  • We are fully insured for public liability and professional indemnity.

  • Davenport’s Landscapes will not be held liable for damage to property unless caused by negligence or breach of contract.

  • Clients are responsible for securing pets and children away from the work area during the project.

  • ​

8. Intellectual Property

All designs, plans, and documents produced by Davenport’s Landscapes remain our intellectual property unless transferred in writing. They may not be reproduced or shared without our written consent.

9. Governing Law

These terms shall be governed by and interpreted in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
